A 14 year old Girl posting nude photos on Myspace, Does punishment fit the Crime?
A 14-year-old New Jersey girl has been accused of child pornography after posting nearly 30 explicit nude pictures of herself on MySpace.com – charges that could force her to register as a sex offender if convicted.
The case comes as prosecutors nationwide pursue child pornography cases resulting from kids sending nude photos to one another over cell phones and e-mail. Legal experts, though, could not recall another case of a child porn charge resulting from a teen’s posting to a social networking site.
MySpace would not comment on the New Jersey investigation, but the company has a team that reviews its network for inappropriate images. The National Center for Missing and Exploited Children tipped off a state task force, which alerted the Passaic County Sheriff’s Office.
The office investigated and discovered the Clifton resident had posted the “very explicit” photos of herself, sheriff’s spokesman Bill Maer said Thursday.
“We consider this case a wake-up call to parents,” Maer said. The girl posted the photos because “she wanted her boyfriend to see them,” he said.
Investigators are looking at individuals who “knowingly” committed a crime, he said, declining to comment further because the case is still being investigated.
The teen, whose name has not been released because of her age, was arrested and charged with possession of child pornography and distribution of child pornography. She was released to her mother’s custody.
If convicted of the distribution charge, she would be forced to register with the state as a sex offender under Megan’s Law, said state Attorney General Anne Milgram. She also could face up to 17 years in jail, though such a stiff sentence is unlikely.
The sex offender registry was a great idea in it’s conception but is quickly being diluted with people who don’t belong on it. The girl is stupid, that’s for sure. Her behavior certainly should be punished to get the point across to her and act as an example to others. Enabling those who enjoy child porn is deserving of the distribution charge.
Is she a dangerous sex criminal posing a threat to those around her? No, and concerned citizens shouldn’t have to sift around her when seeking out if there are true threats living their community. Is the stigma of the sex offender status deserving to her, I don’t think so.

that’s freakin ridiculous! it is her own body she can do whatever she wants with it. if she willingly took the pictures and posted them herself then there is no crime here. it is a stupid thing to do, but not stupid enough for that kind of punishment.
and hey, at least she isn’t a teen idol posting pics and pole dancing at award shows…..*cough cough* those are the kinds of people who need to be punished

I think that’s a bit insane to make a 14 year old child register as a sex offender and face 17 years in jail. I think the more appropriate thing would be to give them a month or so in a kiddy detention center then put them on probation to not be able to use the internet or a computer for a year. That way not only would the child suffer consequences but the parent’s would get the point when no computers would be allowed in the home or internet access, it would force them to become responsible for their children.

Just when I thought I heard everything. What will kids think up next. I’m not certain she should be registered as a sex offender, but certainly some form of disciplinary action should be taken. Her parents should also feel the brunt of the law. Obviously there was little control over their daughter’s use of the internet and the family camera. It sounds like she was spending too much time unsupervised.

I don’t think its right. Do people, even children, have any control over their bodies. If anything she should be charged with indecent exposure, just as a teen would if they went streaking, or something of that such. The girl needs serious help though for doing it in the first place. Why does she wasn’t people to see her naked so bad, to have attention.

i dont think that the name is right for this i think they should come up with a new name under the title child porn because its the child or youth them selves thats taking the pictures .. these people know the difference between right nd wrong just choosing to be slutty ….
i dont think that a jail sentence makes any sence nore is it fair its her parents raising her wrong that is the problem if shes too young to post them why is she getting the punishment of a person who is old enough to ??

These kids should be forced to attend autopsies that are performed on minors who have been kidnapped, raped and murdered by predators on line. They should be made to accompany the police when a dead boy or girl is found dumped in some wooded area after being killed by one of these sickos. They need to see the reality of what can and probably will happen to them if they continue to play with fire. It is the only "wake up" call they really need.

Well the punishment hasn’t been handed down yet but the charge absolutely fits the crime. I watched something similar on the Today show last year and the sad fact of the matter is that if you post pictures of a naked minor then you are distributing child pornography. Once it is out there in cyber space you can not control who sees it or what happens as a result. So if little Susie posts naked pics of her 14 yr old body and then some pedophile gets his sleezy hands on it and uses it to pleasure himself until that isn’t enough so he nabs a look a like from the local mall and rapes her then isn’t little Susie just adding to the pedophile problem? Kids have to know that it is serious and they can not do stupid things at 14 and think they won’t effect her life in 10 or 20 years. Now I doubt she will really serve time and she is a minor so her record will likely be sealed and she won’t have to register as a sex offender her whole life BUT she should be held be responsible legally if for no other reason then to set an example for othe kids considering doing the same immature, irresponsible thing.

Wow, that’s actually a tough call.
I think the sentence is more in punishment of the parents, and a wake up call for them, than it is a punishment for the kid.
The bottom line is, this girl is a kid. A person’s brain isn’t even fully developed until they’re in their twenties. I think the parents should be held responsible, to some extent.
So I don’t really have answer… It’s a really tough call.

I don’t think minor’s should be registered as sex offenders. So that would get rid of that problem. The thing is the investigators spend A LOT of time and money tracking down things like those photos, and expect a nice heavy conviction for their trouble.
They likely also want to make an example to other kids who may want to do the same thing.
But whatever the verdict is, her record would likely be wiped clean at 18 years old anyway, so it still isn’t as big a punishment as if an adult did it.
I find it worse what they do to men who sleep with girls who lied about their age, or father’s who’s daughters friends happen to see them naked because the father didn’t know the girls were hanging out in his bedroom when he stepped out of the shower.
A lot of innocent people get very hurt by those anti-pornography laws etc. She would just be one more victim of it in a very long line of people.

No its her own body I could see if another child was spreading the pictures they might get fined or maybe even a small sentence obviously an adult spreading the picture around knowing the girl was underage should get that kind of hefty sentence but obviously the girls just dumb and needs a good smack across the face and a punishment for her parents for doing something so retarded.
